Article 1: General terms
Nieuw Museum BVBA is a Belgian business with a registered office in 8000 Brugge, Hooistraat 38 with VAT-number BE0894806489, trading online under the name: www.shop4.beer hereinafter referred to as ‘shop4beer’.
These general terms and conditions apply to all items from the range of “shop4beer” and every purchase that the customer places with www.shop4.beer
The customer accepts that these conditions will be the only ones that apply.
Article 2: Terms of delivery
The products which shop4beer offers are only available for customers within the European Union. Products ordered from shop4beer are normally shipped to the customer within 5 working days. shop4beer is not responsible for any delays in the parcel service.
Article 3: Price and Offer
The prices listed are always VAT and other taxes inclusive. Transport costs will be stated separately and will be calculated according to the amount of the purchase and the country to which the order will be shipped.
The offered articles contain a description in words of what exactly is offered at the stated price. The image accompanying the article is purely illustrative and is not tied to the offered article.
The offered articles are exclusively intended for normal private use. Despite the fact that the catalog and website have been compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. If you have specific questions about, for example, availability, delivery method, or delivery time, please contact us by email.
The accuracy or completeness of the information provided by shop4beer is only bound by a means of obligation. shop4beer is not responsible for typing errors. The offer is valid as long as stocks last and can be adjusted or withdrawn at any time.
Article 4: Purchases
All articles offered by shop4beer can be purchased online. After the purchase, the customer receives a confirmation email. Only then will the purchase be made.
The customer has the following options:
- The order can be delivered at home with a payment of the transport costs
- The order can be picked up free of charge @ In’t Nieuw Museum – Hooistraat 42 – 8000 Brugge (after an appointment has been made)
Payment is made by bank card or another supported option.
Shop4beer can refuse an order without giving any reason. If the order ordered contains items that are temporarily out of stock for exceptional reasons, the order can be reduced by the items in question. The customer is notified of this by email. The articles, delivered or collected, remain the exclusive property of shop4beer until payment is made by the customer. However, the risk of loss or damage transfers to the customer from delivery.
Article 5: Withdrawal
The customer has the option to cancel the purchase within a reflection period of 14 days. This reflection period starts from the moment the customer has received the goods from shop4beer or its transporter. This revocation means that the customer waives his purchase.
During the reflection period, the consumer will handle the goods and packaging with care. He will only unpack the goods to the extent necessary to determine the nature and characteristics of the articles. The customer will handle the items as he should.
Dirty, used, opened, damaged or incomplete goods can under no circumstances be retracted.
Article 6: Exercising the right of withdrawal and its costs
The consumer can exercise his right of withdrawal if he reports this within the reflection period using the model withdrawal form. (see Attachment 1)
As soon as possible, but within 14 days after notification of the right of withdrawal, the consumer will return the goods at his own expense and in original condition and packaging.
If the goods have been collected from the “In’t Nieuw Museum”, they can also be returned on site of their own accord and within 14 days after notification of the right of withdrawal.
The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lie with the customer.
Article 7: Obligations of shop4beer upon withdrawal
When shop4beer receives the notification of withdrawal from the consumer, he will send a confirmation of receipt.
Shop4beer will reimburse all consumer payments that can be charged directly for the returned product.
Shop4beer uses the same payment method that the customer used for reimbursement unless the customer agrees to a different method. The refund is free of charge for the customer.
If the customer has opted for a more expensive method of delivery than the cheapest standard delivery, Shop4beer does not have to reimburse the additional costs for the more expensive method.
Articles with an expiration date of fewer than 3 months cannot be revoked.
Article 8: Warranty
Shop4beer guarantees that the goods comply with the agreement, the specifications stated in the offer, the usability, and the legal provisions and / or government regulations existing on the date of the conclusion of the agreement. Any defect must be reported to Shop4beer within 7 days of receipt, together with proof of purchase.
The warranty never applies to defects arising from accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to follow the instructions for use or manual, modifications or changes to the item, heavy-handed use, poor maintenance, abnormal or incorrect use.
Nor does it apply to articles with a shorter life span, or wear items. The warranty is not transferable.
Article 9: Complaints
Any visible damage and / or qualitative shortcoming of an article or other shortcoming on delivery must be reported within 7 days, under penalty of forfeiture of any right. All perishable items offered on Shop4beer have a minimum shelf life of 3 months.
Article 10: Privacy
Shop4beer undertakes to use all data entered by the customer in the webshop only for handling and delivering the purchase. The data will be used as confidential information and will never be passed on or sold to someone else. Your data is stored in a customer file and can be requested, changed, or deleted at any time. This can easily be requested by email.
Article 11: Intellectual property
All intellectual property rights with regard to www.shop4.beer including those with regard to the software, texts, images, and sounds, rest with Bierstekers and/or those from whom we have obtained a license. This means, among other things, that it is not permitted to make public, reproduce, and / or edit the information stated on www.shop4.beer without our permission, except for personal use.
Article 12: Evidence
The customer accepts that electronic communications and backups can serve as evidence.
Article 13: Disputes
In case of any disputes, only the courts in Belgium are competent.
